CHPVA Announces That the CTTT Has Made a Preliminary Injury Determination Against Decorative Plywood From China

The Canadian Hardwood Plywood and Veneer Association (“CHPVA”) is pleased to announce the Canadian International Trade Tribunal (“CITT”)’s positive preliminary injury determination concerning decorative and other non-structural plywood exported from China.

For many years, China has sold large volumes of decorative plywood in Canada at very low prices. On April 21, 2020, the CHPVA, along with Columbia Forest Products, Husky Plywood (a Division of Commonwealth Plywood Co. Ltd.), and Rockshield Engineered Wood Products, ULC, with the support of Precision Veneer Products, Ltd. and ProPly Custom Plywood Inc., filed a complaint with the Canada Border Services Agency (“CBSA”) alleging that these goods are illegally dumped and subsidized, and have caused injury to Canadian producers and workers.

The CITT’s preliminary determination was made on August 10, 2020 and represents an important first step in the case for the domestic producers. If the CBSA issues a preliminary determination of dumping and subsidizing, provisional duties will be in force as of September 9, 2020. In exceptional circumstances, the Special Import Measures Act also allows for the imposition of anti-dumping duties retroactively.

If the CBSA issues a positive final determination on December 8, 2020, and the Canadian International Trade Tribunal finds that these imports have injured or threaten to injure domestic producers of decorative plywood, duties will be in force for an initial period of 5 years as of early 2021.
